Essential Duties:
The following duties are considered essential for this job classification:
- Conducts field investigations to determine violations of City Code regarding building, nuisance, zoning, pest infestation, noise, smoke, junk and debris, abandoned/inoperable vehicles, and related ordinances
- photographs and collects evidence, contacts responsible parties
- drafts letters; performs follow-up investigations to ensure that remedial action has been taken
- develops and maintains accurate case files
- responds to complaints
- interviews complainants and property owners/tenants in cases potentially involving multiple City Code violations to assess the need for permits or determine requirements for resolution of violation(s)
- reviews and analyzes records and documents to make legal nonconforming use determinations
- interprets and explains City Codes, ordinances and abatements regulations
- researches and analyzes City and County records, property history files and maps
- meets with design professionals and plan check personnel to assist resolving code violations
- issues stop work orders, notices of violations, notices to vacate orders
- prepares written reports, issues administrative citations
- prepares and records notice of noncompliance and administrative liens, prepares and records release of notice of noncompliance
- prepares and executes inspection warrants with the assistance of the City Attorney's Office
- schedules and coordinates attendance to Administrative Hearings
- makes oral and written presentations to the administrative hearing officer on unresolved enforcement cases and may represent the department at other legal proceedings
- works with complainants and property owners or tenants to suggest alternatives and resources available within applicable codes, ordinances and regulations to resolve violations
Additional Duties:
In addition to the duties listed in the Essential Duties Section, each employee in this classification may perform the following duties. Any single position may not be assigned all duties listed below, nor do the examples cover all duties which may be assigned:
- Authorize the issuance of permits for work to be performed
- assist in the checking of building plans
- assist in the preparation and coordination of pertinent documents to assist in the resolution of code enforcement and interpretation disputes
- testify in court
- perform code inspections of mobile homes and mobile home subdivisions
- make presentations to various City Boards and Commissions
- assign new addresses and resolve addressing disputes
- assist in neighborhood cleanup events
- perform related duties as assigned
Knowledge of: Accepted safety standards, principals of property maintenance and methods of construction applicable to the full range of building code enforcement activity commonly occurring within the community; building related codes and ordinances enforced by the City, including the California Building Code, International Property Maintenance Code, zoning ordinances, other City environmental codes and energy regulations; principles and techniques of code enforcement and building code violation investigation. Individuals must have a thorough understanding of legal access requirements to investigate/inspect on private property.
Ability to: Effectively apply technical knowledge, interviewing, investigatory and safety techniques and practices; read, understand, explain, investigate and enforce complex codes, policies and procedures to property owners, tenants, developers, contractors, building review and construction inspection staff, and the public; follow proper code enforcement investigation techniques to examine structures and site conditions and detect deviations from plans, regulations and standard construction practices in all areas of the building environment; write complex reports and follow oral and written instructions; keep clear and accurate field notes; communicate effectively both orally and in writing, sometimes in adversarial situations; maintain effective and cooperative working relationships with other employees, City Officials, property and business owners, design professionals, plan check and inspection staff, builders, contractors and the general public; conduct inspections and investigations; research and analyze records, property history files, maps and documents; gather information, draw proper conclusions concerning City Code violations and follow-up to achieve voluntary compliance; prepare and maintain concise, professional, comprehensive reports, correspondence and records; operate standard modern office equipment and City vehicles; learn codes and seek knowledgeable sources to obtain information necessary to perform duties; utilize electronic information systems, such as GIS, to analyze and interpret such information; read and interpret building plans, specifications and building codes; advise on standard maintenance and abatement issues and requirements; make mathematical computations rapidly and accurately; apply City codes and policies regarding zoning, environmental matters and other regulations to field situations; work independently without supervision; enforce necessary regulations with firmness and tact.
Experience and Education: Any combination equivalent to experience and education that could likely provide the required knowledge and abilities would be qualifying. A typical way to obtain the knowledge and abilities would be: Experience - Sufficient responsible experience in a variety of building construction work or related code enforcement work which demonstrates possession of the required knowledge and abilities. Education - Equivalent to the completion of the twelfth grade.
License or Certificate:
This classification requires the use of a personal or City vehicle while conducting City business. Individuals must be physically capable of operating the vehicle safely and must possess and maintain an appropriate valid California motor vehicle operator's license. Individuals must obtain within one year of hire, and maintain throughout employment, a Code Enforcement/Compliance Officer certification from an accredited professional organization and one of the following inspection certifications from an accredited professional organization: Building or Combination Building Inspector certification applicable to job assignment and approved by the Chief Building Official. Individuals must obtain within one year of hire, and maintain throughout employment, PC832 Certification (training course for peace officers) through an accredited P.O.S.T. academy.
Working Conditions and Physical Requirements:
The nature of the work requires the individual to work with potentially uncooperative and hostile individuals. This position requires the ability to climb ladders or scaffolding ranging up to 60 feet in order to access and walk on roof tops; and the ability to access and enter cramped quarters such as crawl spaces located under homes or spaces such as attic areas. Working within the crawl spaces or other areas may bring the code compliance officer into contact with reptiles, insects, and/or mammals such as cats, dogs, rodents and/or bats. While conducting an inspection it may require the incumbent to walk over rough uneven, rocky, wet or slippery surfaces, and to jump over trenches and other obstacles. Inspections occur year round involving all weather types typical of the region; work is performed in a variety of environments including indoors, outdoors, working alone, working around moving objects or vehicles and motorized equipment; may also require entering unsanitary and potentially hazardous waste areas.
